Car Rental/Lease Contract

Maintenance Of vehicle.

The vehicle is rented with the understanding that the renter will have no limitation/ unlimited mileage at the end of the rental period and that the rental fee is inclusive of major repairs and cost of replacement of vehicle parts.
The renter will notify the owner when major repairs are due to enable the owner make the necessary booking with the vehicle dealer. In the period when the vehicle is under repair, the owner will make replacement car of similar or higher standard available for use by the renter.

Car Rental Contract
The Owner represents that to the best of his knowledge and belief that said vehicle is in sound and safe condition and free of any known faults or defects which would affect its safe operation under normal use.
Rental Period
The Owner agrees to rent the above-described vehicle to the Renter for a period of ........ beginning on ……………… .201*.and ending on ................ 201*.
The Renter agrees
(a) that the rented vehicle shall not be used to
carry passengers or property for hire;
(b) that the rented vehicle shall not be used to
carry passengers other than in the interior or cab of the vehicle;
(c) that the rented
vehicle shall not be used to carry passengers in excess of the capacity thereof;
(d) not to use the vehicle to push, propel or tow another vehicle, trailer or any other thing without the
written permission of the owner;
(e) not to use the vehicle for any race or competition;
(f) not to use the vehicle for any illegal purpose;
(g) not to operate the vehicle in a negligent manner.
(h) not to permit the vehicle to be driven by any other person, except its designated and duly licensed drivers communicated at the beginning of this agreement. All assigned staff of the renter can use the vehicle but may not drive the vehicle without the written permission of the owner; and
(i) not to carry passengers, property or
materials in excess of the rated weight carrying capacity of the vehicle.
Insurance:
The owner will rent the car to the renter with a third party insurance cover within Uganda’s/Rwanda borders. . Self drive vehicles only carry Third Party Insurance. This insurance will cover damages to another vehicle/third party. The renter is liable for the full cost of repairs of damages to the rented vehicle.

Rental Rate
The Renter hereby agrees to pay the Owner at the rate of US$... per ..... self drive, exclusive of fuel , Total US$.........payable in cash in advance at the beginning of the rental on ..... 201*,for the use of said vehicle. All fuel and regular service if applicable shall be paid for by the renter.
Deposit-
The Renter further agrees to make a deposit of $ 500 with the Owner, said deposit to be used, in the event of loss of or damage to the vehicle or equipment during the self drive term of this Agreement, to defray fully or partially the cost of necessary repairs or replacement, normal wear and tear having been considered.
In the absence of damage or loss, said deposit shall be credited towards final payment of the rental fee and any excess shall be returned to the Renter.
Return of Vehicle to Owner
The Renter hereby agrees to return said vehicle to the Owner at not later than… 201* ………………… .(subject to further extension of rental, which would be communicated in writing)
Termination clause:
This agreement can be terminated by either party as long as a thirty days notice is duly served in writing and the other provisions are not contested.
SELF DRIVE INFORMATION & CONTRACT
TERMS & CONDITIONS
- Renters must present a copy of their passport and valid driving license before the vehicle will be released.
- Renters will be required to sign this car hire contract and a liability waiver before the vehicle will be released.
- A non-refundable deposit of (25% of the total rental cost) must be paid when reserving the vehicle.
- A refundable security deposit of $500 must be made prior to the vehicle being released to the renter.
- There are no refunds for vehicles returned earlier than the agreed return date set at the time of rental.
- We reserve the right to inspect the vehicle during the hire term and can withdraw the contract at any time.
- No person other than the renter should drive the vehicle.
- Renters agree not to drive the vehicle when under the influence of drugs or alcohol.
- The renter is responsible for all passengers in the vehicle. The renter shall remain solely responsible for any loss, damage, or compensation that may occur to any person or property.
- Monthly rentals are intended for town/locality use only. Please inform the office if you would like to take the vehicle out of the designated rental area.
- Renters wishing to take a vehicle outside the designated rental area must receive approval for this travel.
- Vehicles may not be taken across international borders.
- Renters visiting the national parks in the rented vehicle must follow all the national park rules and regulations
Maintenance/ Damages/ Loss
- Renters are required to recognize and promptly repair leaking or punctured tyres.
- Renters are required to check and refill water and oil reservoirs regularly (vehicles driven in town weekly/upcountry daily).
- Renters are required to fill fuel only at larger gas stations, such as BP and Total. In some of the smaller gas stations, diesel or petrol is sometimes mixed with other materials. Dirty fuel can damage the engine.
- Renters are liable for the costs of repairs due to negligence, reckless and/or careless driving.
- Renters are required to replace broken windscreens, windows, mirrors and damaged tyres.
- Renters are required to replace items lost or stolen from a vehicle (including spare tyres, jacks and other tools rented with the vehicle).
- Renters shall not use the rented vehicle to tow or push another vehicle.
- The vehicle shall not be used for the smuggling or carrying illegal goods or items. If the vehicle is used for smuggling or carrying illegal good or items and is caught and or seized by any authority, the renter is responsible for and will pay for any costs incurred as a result.
INSURANCE
Self drive vehicles only carry Third Party Insurance. This insurance will cover damages to another vehicle/third party. The renter is liable for the full cost of repairs of damages to the rented vehicle.
Comprehensive Insurance is available at an additional cost to renters who would like additional coverage. This covers loss or damage to the rented vehicle by accident, theft, fire and insured legal liability arising out of death or bodily injury to third parties and damage to third party property.
RECEIVING & RETURNING VEHICLES
Vehicles must be picked up and dropped off at an agreed location/ Office at an greed time. Vehicles must be returned in the condition in which they were received aside from general wear and tear from a safari. Vehicles will be inspected for loss and damage. Charges will be deducted from cash security deposits or charged to the renter’s credit card according to the preference of the renter.
BREAKDOWNS
All vehicles are checked and serviced before being rented out. However, because of the rough driving conditions of the rental coverage areas(Uganda/Rwanda/Kenya/Tanzania and in some rare cases Congo, there are times that there are unexpected problems with vehicles.
- Renters of vehicles are required to return the vehicles to our nominated garages for all repairs when the vehicle has a problem while in, or around Kampala/Kigali (Less than 50 kilometres from Kampala/Kigali town centre).
- Renters may take vehicles to another garage when a minor problem occurs while driving outside of the Kampala/Kigali area (more than 50 kilometres from Kampala/Kigali town centre).
- When bringing a vehicle to any garage please do not leave valuables in the vehicle (even the car tool kit) as it is not uncommon for items to be stolen at the garage.
- In the case of a major breakdown we will supply a mechanic and a new vehicle as soon as possible (contact the office at the numbers listed ). Drivers cannot travel at night. If a breakdown occurs late in the day a driver can be sent no sooner than early the next morning.
- Renters wishing to take a vehicle outside the agreed borders must receive approval for this travel.
- Renters who travel outside of the pre-approved travel areas will be required to repair vehicles at their own expense and depending on the nature of the repairs may receive reimbursement of costs incurred when they return the vehicle. To receive reimbursements renters must provide receipts.
ACCIDENTS
In the event of an accident,
- First contact the police. It is mandatory that you receive a police report for any traffic incident.
- Then contact our office (we may be able to help you with the police procedure).
- After an accident do not leave the vehicle unattended as it is not uncommon for unattended vehicles to be vandalized.
- We will supply a vehicle to replace your damaged vehicle if there is one available. Availability cannot be guaranteed.
DEPOSITS & PAYMENT
For Self Drive Vehicle Rentals a non-refundable deposit of 25% of the total cost of the booking is required.
We do not give refunds for vehicles returned earlier than the date agreed upon at the time of rental.
Payment of remaining balance
The rental balance may be paid through a wire transfer or in cash . If paying in cash, we accept US dollars, Euros or Pounds Sterling. For US dollars, we accept only notes of US$50 and US$100 and do not accept any notes printed before the year 2000 (this applies generally in Uganda, Rwanda, Kenya and Tanzania many banks and exchange bureaus do not accept notes before the year 2000).
We also accept most major credit card payments via paypal. For credit card payments a charge of 5% of the total balance will be added to cover processing fees we incur.

Please drive carefully and obey the posted speed limits

You may be stopped by the police for a vehicle inspection to check for
insurance and road licence (these are the stickers on the windows)

Please be careful when parking in Kampala/Kigali/Nairobi /Arusha and other towns.
Lock the vehicle and close all windows. Vandalism of unattended cars is not uncommon.
Park in designated parking areas only. There is a penalty of approximately US$50 for parking in an unauthorized area.
Please pay the parking fee . Parking attendants wearing uniforms will collect the fee and give you a parking ticket. Display the ticket on the dashboard. Parking fines incurred are the responsibility of the renter.
